Warren Stracener Unable to grasp the "elements of crime"?

In a heavily redacted document obtained by the web master Stracener authorized the detention of a citizen (for about 48 hours) without legal probable cause.

In the evening hours of June 2011 a DUI check point was being conducted on Missouri Flat Road in Placerville.  A motorist enters the check point area and is arrested for DUI.

Every arrest requires an officer to provide a declaration of probable cause in order to cause the arrestee’s detention in jail. Below is the verbatim verbiage the arresting officer presented to the on call judge (Stracener) to approve the arrest.

“FACTS ESTABLISHING ELEMENTS AND INDENTIFICATION On ____ at approximately 2155 I was on duty in uniform at a post in a DUI checkpoint on Missouri Flat Road north of Forni Road. I observed _______ drive his vehicle into the check point and I motioned to stop at my location. _____ was identified by his California Drivers License. “    

The officer contacted Warren Stracener and verbally read the above declaration to him via telephone.

The above statement presents zero elements of a crime being committed. As the statement reads Stracener would authorize every motorist passing through the DUI check point to be arrested and jailed.

Some sample elements of a DUI arrest:

1.       The driver smelled of alcohol.

2.       The driver was disoriented and confused.

3.       The driver was unable to control the vehicle.

4.       The driver had an alcoholic beverage in his hand.

5.       The driver was given a field sobriety test and failed.

6.       The driver was tested with a portable alcohol detection devise, results indicating high levels.

Not a single element of crime existed, yet Warren Stracener jailed this person.

Warren Stracener shows no regard for the Court or the people appearing in it.
Where was Stracener on Monday April 23, 2012 for his 8:00am calendar?

Answer: Out politicking at a tax-payers candidate debate, Denny’s Fair Lane in Placerville. (Yes at the expense of the public)

Here’s how it breaks down:  
Straceners court had six (6) cases scheduled at 8:00am, and two (2) more at 8:30am.
Stracener chooses to disregard the public’s valuable time and attends a political function at a local restaurant, arriving for his 8’oclock calendar at 9:00am. This arrogance shows he is far more important than those appearing in his court.

Of course we have heard the multitude of complaints of Stracener constantly forcing people to stay late because he doesn’t know the law and can’t make a decision. But now he is just showing up late, and that is just plain wrong.
